The Education Department proposes to make faculty viewpoint policy an accreditation standard
The Education Department published a notice of proposed rulemaking that would require accrediting agencies to evaluate whether the institutions they accredit maintain academic freedom protections applied consistently to faculty regardless of viewpoint or ideology, and to require that accreditation standards prioritize intellectual diversity among faculty.
What happened
The proposed rule would amend 34 CFR 602.17 to clarify expectations for reviewing student achievement and faculty related policies, including academic freedom and intellectual diversity. Under the proposal, agencies would need to evaluate whether institutions have policies protecting civil rights and, as applicable, First Amendment rights, and whether those policies include academic freedom protections applied consistently to faculty regardless of appointment classification, race or other immutable characteristics, viewpoint, or ideology, unless the institution has a religious mission. The Department states the proposal advances academic freedom, intellectual inquiry and student learning by ensuring that accreditation requires institutions to support and prioritize intellectual diversity among faculty. During negotiated rulemaking the Department had proposed a definition of academic freedom and subsequently removed it after a few negotiators dissented, proposing instead to require agencies to adopt standards for evaluating whether an institution has a policy for academic freedom. The Department reproduced that removed definition in the preamble as non-binding proposed language, stating that it is not requiring agencies or institutions to apply the definition but that an agency or institution applying it would meet the requirements of the executive order and the proposed regulations. Comments are due on or before September 21, 2026.
Why it matters
Accreditation is the switch that controls an institution's access to federal student aid, and this proposal moves the condition upstream: rather than acting against a university, the Department would write into the recognition standards that every recognized accreditor must grade its institutions on faculty viewpoint policy. The Department kept its definition of academic freedom out of the regulatory text after negotiators dissented, and instead published that definition in the preamble as non-binding language it says would satisfy the rule — so what binds is that an institution have a policy, with the Department's own reading of what the policy should say carried alongside the rule rather than in it.
