Trump rebukes his own U.S. attorney over dropped Reflecting Pool charges
President Trump publicly contradicted his own Justice Department after prosecutors moved to drop the Lincoln Memorial Reflecting Pool vandalism case, posting on Aug. 1 that he disagreed “100%” with U.S. Attorney Jeanine Pirro and that “the major damage was caused by VANDALS!” He repeated the rebuke in public over the following days — on Aug. 3 saying Pirro “choked” and “folded like an umbrella” and declining to answer a reporter's question about whether he was reconsidering her role, and on Aug. 4 that she “was totally wrong.”
What happened
Prosecutors had told the court on Friday that new Interior Department records showed the damage “was the result of flawed installation by the contractor, Atlantic Industrial Coatings,” and moved to dismiss the felony indictment against former Olympic canoeist David Hearn. Trump had handpicked Pirro as top federal prosecutor in the nation's capital; on Aug. 3 he ducked questions about whether he would fire her, saying “Frankly, I think she choked,” and that evening laid into her at a White House meeting where, two sources briefed on it told CNN, he yelled at her and “read her the riot act.” Asked the next day whether Pirro would remain as U.S. attorney, Trump declined to commit either way: “I haven’t made a determination.” The federal government dropped the charges against the three remaining Reflecting Pool defendants as well.
Why it matters
Pirro is the President's handpicked top federal prosecutor in the nation's capital, and the case her office abandoned was one he wanted pursued — the Associated Press reported that he wanted the defendant “indicted, tried and possibly imprisoned.” The AP also reported that by publicly rebuking her, Trump “sent a message to other administration officials that he is not to be contradicted, regardless of what the facts show.” Whether a charging decision is made on the record or against a stated presidential expectation is the pressure this indicator follows.
